House Republicans Pull Healthcare Bill after Failing to Secure Necessary Votes

This past Thursday, March 23rd, the U.S. House Republicans were scheduled to hold a vote on the American Health Care Act. The vote was to come on the seventh year anniversary of Barack Obama having signed the Affordable Care Act into law. However, after fruitless efforts by House Republicans to muster enough proponents, the vote was initially delayed until the afternoon of Friday, March 24th. The vote was then delayed, yet again, prior to anticipated defeat after reports of Paul Ryan “rushing to the White House to tell Trump votes are lacking to repeal Obamacare” flooded the media.

Employer Obligation to Report Survives First Legislative Proposal

Since the March 6th release of Republican’s Affordable Care Act replacement plan, otherwise known as the American Health Care Act, the proposed legislation has been subjected to criticism seemingly outweighing its praise. For employers currently finalizing their 2016 IRS reporting requirements, one hope may be that the year-long tracking, reporting, and data collection essential to this process would be eliminated. However, a review of the proposed legislation suggests that employer obligations to report may be far from over.

Republican’s ACA Replacement Bill Released

Monday evening, House Republicans released their long-awaited “American Health Care Act,” the GOP’s plan to repeal and replace the Affordable Care Act. While the bill strips away much of the ACA, it also retains some of its more well-liked provisions. For example, the bill would eliminate the individual mandate that requires most Americans to have health insurance or pay a penalty and the employer mandate requirement that large employers offer coverage to their employees, but it would allow children to continue to remain on their parent’s plan through age of 26, keep the prohibition on denying coverage based on a pre-existing condition, and would still require a simplified version of employer reporting for offers of coverage made via the employee’s W-2.
